Abbott Upholds SB4 Arrest & Turn Back Law Under Pressure of Federal Law Suit


NATION: In reaction to a new law I stated by Texas Governor Gregg Abbot that plans to charge with a crime any illegal migrant who enters the U.S. at the Texas border, the U.S. DOJ says it will sue the state of Texas. DOJ forwarded a letter to Governor Abbott stating that the law, SB4, is unconstitutional.

This week, US DOJ Deputy Assistant Attorney General, Brian Boynton wrote , in a letter, that the U.S. government will file a law suit against tge state of Texas if itdefies an agreement to enjoin the law and, thereafter, does not refrain from enforcing the law. says Boynton.


After having received the Boynton message, this week, Governor Abbott commented stating that US President Joe Biden is "...destroying America..." adding that 'Texas is trying to save it.'


In a turn of monistic efforts by Texas, lawmakers have indicated that the state of Texas, however, asserts that Senate Bill 4 was drafted in such a manner that it cannot be subjected to law suit.


Contained in SB4 is a mandate that will be enforced by judges to order border agents to execute the arrest of illegal migrants who enter into the state of Texas to, thereby, expel them from the state of Texas by sending them back to their point of origin.


According to Boynton, Abbott's immigration law acts in a manner to challenge the federal government's authority to exercise control over immigration law stating that it is authorized by the constitution.


Abbott established new legislation in 2021 which, now, authorizes state and local law enforcement to take action to carry out the state law.. Texas is taking steps in accordance with Operation Lone Star, a strategy established by Governor Abbott to address and contain the overflowing occurrence of illegal migrants who utilize the Texas border as their route of entry into the U.S.


Governor Gregg Abbott signed SB4 to oreventbto overwhelming influx of illegal migration at the border that separates the US snd Mexico. Following the signing of SB4, the state of Texas was sued by the ACLU .
