Khan stated that the ICC panel of judges is considering both the Hamas October 7 attack on Israel and the deadly results of the attack that killed 1200 Israeli civilian. The panel will, also, look further into matters associated with Israel's response to Hamas' October 7 attack as operations in Gaza come under ICC scrutiny. Today, as it is apparent that Israel urges the ICC to take into consideration the onset of the ongoing conflict that brought about after Hamas launched 2000 missile attack against Israel killing a massive number of Israeli residents during the overnight surprise attacks, the ICC nonetheless looks upon Israel as the aggressor.
