Alabama Judge Denies Smith’s Appeal To Delay Execution


STATE & NATIONAL:One dsy before his execution, convicted killer Kenneth E Smith was approved for execution by use of nitrogen gas.

On Wednesday, the Alabama Corrections Facility received the approval for using nitrogen as a new method of execution in the state.


In a decision that restored executions, the 11th Circuit Court of Appeals denied Smith's plea for a preliminary injunction that would vacate his January 25th execution date.


Nitrogen gas replaces oxygen in any atmosphere where air is rliminated. Nitrogen gas causes dizziness and, ultimately causes death as a result of the elimination of ovygen.


In court, Judge Jill Pryor stated that Smith's attorneys failed to prove that the use of nitrogen gas wound be a violation of the defendant's conditutionsl rights.


The court determined that its obligation to upholding a higher court decision would be upheld while considering that no evidence had been brought into view that would negate the use of nitrogen gas,


Kenneth Eugene Smith's execution by way of nitrogen gas will be performed on Thursday, January 25th.
