STATE & NATIONAL: Special counsel Jack Smith has asked a federal appeals court to reinstate the classified documents case against former President Donald Trump.

The request made by Smith follows a lower court’s decision to dismiss the case, which was based on the argument that Smith’s appointment as special counsel violated the Constitution’s Appointments Clause.
Smith’s team argues that the lower court’s decision deviated from legal precedent and did not adequately consider the historical authority of the Attorney General to appoint special counsels.
The Special Investigators cited previous court decisions, including the landmark Supreme Court ruling in United States v. Nixon, to support their position.
Trump has until September 26 to respond to the special counsel’s arguments.
